General Terms and Conditions (GTC)
for the rental of the holiday apartment “Casa Matteo España” in the Panoramica Golf urbanization in Sant Jordi (Castellón)
§ 1 Scope of Application
These GTC apply to all contracts for the temporary rental of the holiday apartment Casa Matteo España (hereinafter “holiday apartment”) for the accommodation of guests, as well as to all services provided by the landlord in connection therewith.
Deviating terms and conditions of the tenant shall not be recognized unless the landlord has expressly agreed to their validity in writing.
§ 2 Conclusion of Contract
By making a booking (in writing, by email, or via an online form), the guest submits a binding offer to the landlord to conclude an accommodation contract.
The contract is concluded upon acceptance of the booking offer by the landlord, usually by sending a booking confirmation.
By making the booking, the guest acknowledges these GTC.
§ 3 Rental Period, Use, Number of Persons
The rental agreement applies to the period confirmed in the booking offer (arrival and departure dates).
The holiday apartment may only be used by the number of persons stated in the booking offer. Any over-occupancy requires the landlord’s explicit consent.
Subletting or re-letting the holiday apartment, or using it for purposes other than accommodation, requires the landlord’s prior written consent.
§ 4 Rental Price, Payment, Security Deposit
The rental price, including any agreed ancillary costs, is stated in the booking offer.
Upon booking, a deposit of 20% of the rental price is due. The remaining balance must be received by the landlord no later than 14 days before arrival. Alternatively: as stated in the booking confirmation.
The landlord may require a security deposit, which must be paid together with the final payment or provided upon arrival.
If the guest is in default of payment, the landlord is entitled to withdraw from the contract and claim damages.
§ 5 Withdrawal / Cancellation by the Guest
A withdrawal by the guest is only effective if declared in writing (e.g., by email) to the landlord.
In the event of cancellation by the guest, the following cancellation fees apply (as a percentage of the rental price):

up to 30 days before arrival: free of charge (or a minor processing fee)

from 29 to 15 days before arrival: 50%

from 14 days before arrival (including no-shows): 100% of the rental price
These correspond to customary market scales.
If the holiday apartment is re-rented by the landlord, any saved expenses will be credited accordingly; in this case, the flat-rate amount payable by the guest will be reduced.
The guest is expressly advised to consider taking out travel cancellation/interruption insurance.
§ 6 Withdrawal / Termination by the Landlord
The landlord is entitled to withdraw from the contract for good cause (e.g., force majeure, official prohibition, non-payment by the guest).
Payments already made will be refunded to the guest without delay. Further claims by the guest are excluded.
§ 7 Rights and Obligations of the Guest
The guest undertakes to treat the holiday apartment with care, to observe the house and garden rules, and to report any damage to the landlord without delay.
The guest is liable for all damage caused by themselves, their fellow travelers, or visitors.
Pets are only permitted with the landlord’s prior consent.
Smoking in the apartment is [permitted/not permitted] (please adjust accordingly).
Upon departure, the guest must leave the holiday apartment in proper condition (e.g., no excessive trash, furniture in normal condition).
The guest is obliged to comply with local quiet hours and neighborhood regulations.
§ 8 Arrival / Departure
The holiday apartment is available to the guest from 3:00 p.m. on the day of arrival. On the day of departure, the apartment must be vacated by 11:00 a.m. at the latest. Other times may be agreed individually.
If arrival is expected after 8:00 p.m., the landlord must be informed in advance. If the guest fails to arrive on time without prior notice, the landlord may freely dispose of the accommodation after a period of 12 hours.
§ 9 Liability
The landlord is liable in accordance with statutory provisions only for intent and gross negligence.
Liability for slight negligence is excluded, except in cases of injury to life, body, or health.
The landlord assumes no liability for damage or loss suffered by the guest, in particular no liability for stolen or lost items.
§ 10 Force Majeure / Unforeseeable Events
If fulfillment of the contract becomes impossible due to force majeure or official measures, the contract shall be terminated. Claims for rental payment shall cease accordingly.
If alternative use options exist (e.g., replacement tenants), an appropriate credit will be applied.
§ 11 Data Protection
The landlord processes the guest’s personal data in the course of booking and carrying out the stay. Details can be found in the privacy policy on the website.
§ 12 Final Provisions
Amendments and supplements to this contract must be made in writing.
Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
German law shall apply. Place of jurisdiction is Sinzig, Germany (Rhineland-Palatinate).
